Q. What Is A Board Certified Personal Injury Trial Law Attorney?

A. A Board Certified Personal Injury Trial Law Attorney is an attorney who has demonstrated special competence in the field of Personal Injury Trial Law and whose competence has been certified by the Texas Board of Legal Specialization in the field of Personal Injury Trial Law.

The Texas Board of Legal Specialization was created by the Supreme Court of Texas, and the Board members are appointed by the President of the State Bar of Texas. The Board, in turn, administers the program through which an attorney may demonstrate special competence in the field of Personal Injury Trial Law.

A. All Board Certified Personal Injury Trial Law attorneys must:

- Have been licensed to practice law for at least 5 years.
- Have practiced personal injury trial law for at least 3 years
- Devote 25-50% of practice to personal injury trial law.
- Handle a wide variety of personal injury trial law matters to demonstrate experience and involvement including actively pursing cases through trial
- Regularly attend personal injury trial law legal education seminars to keep training up to date.
- Have been evaluated and approved by fellow lawyers and judges.
- Pass a day long written examination.

Q. What special requirements must a lawyer meet who is Board Certified in Personal Injury Trial Law?

A. A lawyer who is Board Certified in Personal Injury Trial Law must have handled jury trials in cases involving vehicle accidents, Workers' Compensation, premises liability, products liability, statutory tort claims, or claims involving mental anguish damages not necessarily accompanied by physical injury. The lawyer must also have extensive knowledge of the law of evidence, procedure and other substantive law in the trial of cases.

Q. How many attorneys are currently Board Certified in Personal Injury Trial Law?

A. According to the Board of Legal Specialization and the State Bar of Texas there are approximately 1,715 Board Certified Personal Injury Trial Law attorneys out of approximately 74,075 licensed attorneys. This means approximately 2.3% of the attorneys licensed in the State of Texas have met the requirements and have passed the extensive written examination to be considered specialists in the field of Personal Injury Trial Law.
